統治者不是橡皮圖章！柔州蘇丹對首相納吉發出獅子吼：請把憲政權力還給統治者！

蘇丹殿下說：現在的當政者已經越來越放肆，不再把統治者放在眼裡；在他們眼中，統治者已經成為沒有實權的掛名君王，只是必須對國會或週會乖乖聽話的橡皮圖章！

柔佛蘇丹伊布拉欣殿下說：自從1994年國陣政府修改聯邦憲法限制統治者權力之後，各州統治者與最高元首已經淪為執政者的橡皮圖章！在制定各種惡法的時候，統治者就算知道相關的法律對人民非常不利，也已經無法阻止。

蘇丹殿下雖然沒有明言，但是大家都懂，蘇丹殿下是針對已經於8月1日正式實施的、被人民強烈詬病的《國家安全法令》（簡稱國安法）；這項法令賦予首相絕對權力對付所有政敵及管控三軍、軍警和執法司法部門都得聽從首相而非最高元首指令。造成首相實權凌駕於最高元首。如果首相是一個貪贓枉法、不理人民死活的獨裁者，那麼這惡法將會帶給全國人民巨大的災難！

在原有的聯邦憲法中，統治者有權否決任何由國會提呈的新法令，只要各州蘇丹或最高元首認為相關的新法令對人民含有不公平、有偏差或賦予執政者過大的專制權力，就可以否決，諭令發回國會重新審核。若修改後仍然不能令人滿意，統治者擁有最後否決權，將相關的新法令或修改的條文作廢。

但是在90年代的憲政危機中，當時的首相馬哈迪利用副手嘉化峇峇與各州統治者周旋、發動民間巨大的輿論迫使統治者妥協；然後在1994年由新上任的副首相安華伊布拉欣在國會提呈修憲動議；三讀通過。

修改後的憲法規定，最高元首必須在首相勸告下簽准各項由國會三讀通過的法案，若最高元首認為法案不夠完善必須修改，則國會將重新討論及投票決定是否必須進行修改；若認為沒必要修改，將再提呈給最高元首御准。如果最高元首在國會規定的期限內沒有簽名御准，相關的法令將自動生效，最高元首無權廢止。

這是當年馬哈迪一手造成的憲政危機，到了納吉上台後，他只是完全按照馬哈迪修憲後賦予首相的無上權力來辦事罷了。納吉目無君王？是的，納吉真的目無君上，但是追根究底，這一切是誰造成的？老馬能夠推卸責任嗎？

類似納吉這類權力狂的政客，一旦嚐到絕對的權力之後，就絕對的腐敗了，柔州蘇丹希望納吉國陣再次修憲恢復統治者的憲政權力，無異緣木求魚，就算納吉答應，羅斯瑪也肯定不會點頭同意。只要羅斯瑪不同意，納吉就算膽生毛也絕對不敢不遵從河馬的指令。

Johor sultan wants powers restored to King, rulers

Sultan Ibrahim says amendment to Federal Constitution in 1994 regards King only as 'rubber stamp' for any laws approved by Parliament.

JOHOR BAHRU: The Sultan of Johor, Sultan Ibrahim Almarhum Sultan Iskandar, today called for an amendment to the Federal Constitution to restore the powers of the Yang di-Pertuan Agong or Rulers to examine and approve bills.

He said this was necessary because it was not appropriate for these powers to be restricted or eliminated.

Sultan Ibrahim said the existing legislation just regarded the role of the Yang di-Pertuan Agong or Rulers as a rubber stamp to affix the seal to any Bill approved by Parliament or a State Legislative Assembly.

「I know that this is true at the federal level and in several states, but not in Johor. I hope this matter can be rectified,」 he said when opening the Conference of Parliamentary and State Assembly Speakers of Malaysia, here.

The Sultan made reference to Article 40 (1A) and Article 66 (4A) of the Federal Constitution.

Article 40 (1A) states: 「In the exercise of his functions under this Constitution or federal law, where the Yang di-Pertuan Agong is to act in accordance with advice, on advice, or after considering advice, the Yang di-Pertuan Agong shall accept and act in accordance with such advice.」

Article 66 (4A) states: 「If a Bill is not assented to by the Yang di-Pertuan Agong within the time specified in Clause (4), it shall become law at the expiration of the time specified in that Clause in the like manner as if he had assented thereto.」

In May 1994, 44 points, including three schedules, in the Federal Constitution were amended by way of a bill tabled in the Dewan Rakyat by then Deputy Prime Minister Anwar Ibrahim.

The Tunku Mahkota of Johor, Tunku Ismail Sultan Ibrahim, also attended the opening of today’s event.

Also present were Johor Menteri Besar Mohamed Khaled Nordin, Dewan Negara President S.A. Vigneswaran, Dewan Rakyat Speaker Pandikar Amin Mulia and Johor State Secretary Ismail Karim.

Sultan Ibrahim said a bill passed by the state assembly can only take effect after it is approved by the Ruler and, as such, it is inevitable that the relationship among the Rulers, the Legislature and the Executive are complementary to one another in the formation of an efficient and effective state government administration.

He said the role of the Ruler in the affairs of the state is also important besides the roles of the Executive and the Speaker and Members of the Legislative Assembly.

The Sultan added that the Speaker must also have in-depth knowledge of the Federal Constitution and the state constitutions and not just the standing orders.

Although the speakers have similar roles and responsibilities, they face varying environments and different elected representatives, he said.

The ruler said it was not an easy task for the speakers to manage parliament or state assembly proceedings because this is not specified in detail in the Federal Constitution or state constitutions.

He expressed his appreciation to Parliament for having selected Johor to host the conference.
